Online Divorce Documents

In recent years, divorce forms have become more accessible online. This has allowed couples seeking a divorce to go through a pro se route. Pro se means that the party is not represented by an attorney. These online forms allow the pro se party to prepare pleadings such as complaints on their own and file them with the Court. It offers an accessible option to those individuals who cannot afford an attorney.  However, though it may seem easy and inexpensive to do the forms yourself it is best to be careful and still consider obtaining an experienced divorce attorney.

Online Divorce packets are free and easily available on your respective superior court’s website. Do not fall into the trap of paying for online divorce forms. It is important to pick the proper packet as there is normally two one for without children and one with children. Make sure to research before starting the divorce process by reading through articles available on lawyer’s websites. Consider consulting a divorce attorney. Paying a small consultation fee just to speak with an attorney about your case and receive legal advice could save money and stress on the backhand. Even if you have already started your divorce process, you can still consult with an attorney on the case. In the consultation, the attorney will give you a retainer quote which is the cost to take on your case.

Downfalls to using Online Divorce Forms

  • Online Divorce forms are general. They are not tailored to your specific case. They will contain general instructions to help with which forms to fill out when but will not contains specifics on the division of assets. This can lead to many problems when it comes to dividing assets between the parties.
  • Online Divorce articles are general as well. While they can inform the individual on divorce in Georgia. They will probably not answer the specific questions the individual has about their divorce case.
  • Since online divorce forms are available on Clerk of Superior Court websites in Georgia, many individuals may call the clerk for specific questions about their case. It is important to note the Clerk’s office cannot give legal advice.
  • Using Online forms will not include the process of discovery normally. This can be detrimental to your case if you do not have access to marital assets such as bank and credit card accounts. Also if your spouse is hiding assets, discovery allows the party to request information related to those hidden assets.

Remember once the Final Judgement and Decree of Divorce is signed and filed by the Judge the divorce is final. This means the Settlement Agreement incorporated into the Final Decree is final as well. It is important to get the divorce agreement right the first time as there is no going back after it is finalized.
